Terms for workers, employers, and hiring businesses

These Terms explain the legal rules, responsibilities, and limitations that apply when you use the Labor App mobile app on Android or iOS, or our website, to discover jobs, post workforce requirements, or communicate with hiring partners.

Introduction and Agreement to Terms

Welcome to Labor App, a workforce hiring and job discovery platform operated by Dofin Tech Private Limited ("Dofin Tech", "we", "our", or "us"). Labor App serves both hiring businesses and individual workers by helping them discover opportunities, evaluate profiles, and connect for lawful workforce engagements.

These Terms of Service ("Terms") govern your access to and use of the Labor App mobile application for Android and iOS — distributed through Google Play and the Apple App Store — together with our website, landing pages, and all associated services (collectively, the "Services"). By accessing or using the Services, you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must discontinue use of the Services immediately.

These Terms are an agreement between you and Dofin Tech Private Limited only. They are not an agreement with Google, Apple, or any app store operator, and those companies are not parties to them. Section 10 sets out additional terms that apply specifically to app store distribution.

Our Privacy Policy explains how we handle your personal data and forms part of these Terms.

1. Eligibility and User Acceptance

Labor App is accessible to different categories of users, each of whom must satisfy the eligibility rules below.

  • 1.1 Minimum Age: you must be at least 18 years of age, or the age of legal majority in your jurisdiction if that is higher, to create an account or use the Services. Accounts we identify as belonging to a minor will be closed.
  • 1.2 Hiring Businesses and Employers: if you use Labor App on behalf of a company, contractor team, agency, or other organisation, you represent that you have the authority to bind that entity to these Terms.
  • 1.3 Individual Workers and Job Seekers: if you use Labor App in your personal capacity, you represent that you are legally permitted to work and to accept the engagements you apply for.
  • 1.4 One Account Per Person: your mobile number is your identity on the Platform. You may hold only one account per role, and you must not create an account using another person's number or identity documents.
  • 1.5 Accuracy of Information: by creating an account or participating in any hiring workflow, you represent and warrant that all information you provide is accurate, current, lawful, and not misleading.

2. Account Registration and OTP Verification

Accounts are created and accessed using your mobile number together with a one-time password (OTP) delivered by SMS. You are responsible for maintaining control of that number and device, and for all activity that occurs under your account.

  • Do not share your OTP with anyone, including anyone claiming to represent Labor App. We will never ask you for your OTP.
  • Notify us promptly if you lose access to your registered number or suspect unauthorised use of your account.
  • Your mobile operator's standard SMS and data charges may apply to messages and app usage.
  • You agree to receive transactional SMS, push notifications, and in-app alerts that are necessary to operate your account, such as OTPs, job matches, application updates, and account notices. Notifications can be turned off in your device settings.

3. Identity Verification for Workers

To build trust between workers and employers, workers are asked to complete an identity verification step in which they submit their Aadhaar number and photographs of their Aadhaar card. Verification is performed with the help of a third-party identity verification provider, and the data involved is handled as described in our Privacy Policy.

  • You must submit only your own genuine identity document. Submitting another person's document, or a forged, edited, or tampered document, is a serious violation of these Terms and may result in permanent termination and reporting to the appropriate authorities.
  • Identity documents and the details taken from them are used only for verification, fraud prevention, and legal compliance. They are not shown to employers or to other users.
  • Verification confirms that a document appears genuine and matches the number provided. It is not a background check, police verification, skill assessment, or credit check, and it is not a guarantee of a worker's character, competence, or work history.
  • Employers remain responsible for carrying out any further checks they consider necessary before engaging a worker.
  • We may re-run verification, request a fresh submission, or restrict an account where verification fails, expires, or is reasonably suspected of being fraudulent.

4. Permitted Use and Prohibited Activities

Labor App is designed for lawful workforce hiring, worker discovery, profile creation, job posting, communication, and related employment-support activities.

  • Permitted use includes browsing job opportunities, creating worker or employer profiles, publishing job requirements, reviewing applicants, and contacting other users for genuine workforce-related purposes.
  • You must not engage in illegal, fraudulent, deceptive, abusive, defamatory, hateful, violent, harassing, or discriminatory conduct through the Services.
  • You must not submit false job posts, impersonate another person or business, provide misleading worker credentials, or misuse the contact information of any user, including for spam, marketing, or recruitment outside the Platform's purpose.
  • You must not collect, copy, store, or redistribute other users' personal information, including phone numbers and photographs, other than as needed for a genuine hiring interaction.
  • You must not interfere with platform security, scrape or bulk-download the Services without authorisation, reverse-engineer or modify the app, use automated tools or bots, or attempt to gain unauthorised access to user data, systems, or accounts.
  • You must not use the Services to solicit or arrange anything unlawful, unsafe, or outside genuine workforce engagement.
  • Violation of these rules may lead to immediate suspension, restriction, or permanent termination of your access without prior notice.

5. Platform Role, Hiring Responsibility, and Payments

Labor App facilitates introductions, search, visibility, and communication between workers and hiring parties. Labor App is not a staffing agency, recruitment guarantor, employer of record, or party to any employment, labour supply, freelance, contractor, or wage arrangement formed between users.

  • Hiring businesses remain solely responsible for verifying candidates, setting and paying wages, complying with labour, wage, safety, and workplace laws, defining job requirements, and meeting all payment obligations.
  • Employers must not post requirements that involve forced labour, bonded labour, child labour, unsafe conditions, or unlawful discrimination, or that offer less than the legally applicable minimum wage.
  • Workers remain solely responsible for the truthfulness of their profile information, qualifications, work eligibility, conduct, attendance, and compliance with applicable laws and safety requirements.
  • Wages are settled directly between the employer and the worker for work performed in the physical world. Labor App does not collect, hold, process, disburse, escrow, or guarantee any wage, advance, deposit, commission, or other payment, and wage amounts shown in the app reflect what the parties themselves have stated, not a commitment by us.
  • The Services do not sell digital content, unlockable features, subscriptions, or any other in-app purchase. Access to the app is currently free for both workers and employers; if we introduce paid features in future, the pricing and payment method will be disclosed before you are charged.
  • Labor App does not guarantee hiring outcomes, job availability, worker suitability, payment completion, attendance, or workplace conditions. Any dispute about wages, work quality, or conduct is between the users concerned.

6. Reviews, Ratings, and User Content

After an engagement, workers and employers may rate and review each other. Reviews are visible to other users and influence how profiles appear on the Platform.

  • Reviews must be honest, first-hand, and based on an actual engagement. Fake, incentivised, retaliatory, or coordinated reviews are prohibited.
  • Do not include abusive language, threats, discriminatory remarks, or another person's private information such as identity numbers, addresses, or bank details in a review.
  • We may remove or moderate content that violates these Terms or applicable law, and we may restrict accounts that repeatedly do so. We are not obliged to monitor all content, and we are not responsible for content submitted by users.
  • You can report objectionable content or an abusive user from within the app or by contacting us; we review such reports and act on them within a reasonable time.
  • You retain ownership of the job posts, profile descriptions, photographs, reviews, and other material you submit. Ratings you have given may remain visible after your account is closed so that other users' rating history stays accurate.

7. Device Permissions, Location, and Notifications

Some features of the mobile app rely on device permissions that you grant, and that you may withdraw at any time from your device settings on both Android and iOS.

  • Location is used while the app is in use to show nearby jobs and workers and to set worksite locations. Background or always-on location is never used.
  • Camera and photo access are used for your profile photograph and for identity document capture.
  • Notification permission is used to deliver job alerts and account notices.
  • Declining or withdrawing a permission will limit the related feature but will not close your account. Locations, distances, and map results shown in the app are approximate and should be confirmed before you travel to a worksite.

8. App Licence and Updates

We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the Labor App mobile application on a device you own or control, solely for the purposes permitted by these Terms. All rights not expressly granted are reserved.

  • The app may download and apply updates automatically, including over-the-air updates to app content and fixes. Some features may require you to be on a recent version.
  • You may not sublicense, sell, rent, lease, distribute, or make the app available to others, and you may not remove or alter any proprietary notices in it.
  • You may install and use the app on any device that you own or control, as permitted by the usage rules of the app store you obtained it from.

9. Intellectual Property Rights

All software, platform architecture, interface elements, branding, trademarks, logos, content design, and related intellectual property associated with Labor App are owned by Dofin Tech Private Limited or its licensors.

  • You retain ownership of job posts, profile descriptions, text, images, and other material that you submit through the Services.
  • By submitting content, you grant Dofin Tech Private Limited a limited, non-exclusive, revocable licence to host, display, store, process, and use that content solely for operating, improving, and securing Labor App.
  • You may not copy, distribute, resell, modify, reverse-engineer, or create derivative works from the platform or its branding without prior written permission.

10. Additional Terms for App Store Distribution

The following terms apply in addition to the rest of these Terms, according to the store from which you obtained the Labor App application. Where these terms conflict with anything else in this document, these terms prevail for the store concerned.

If you downloaded the app from the Apple App Store, you acknowledge the following. These Terms are concluded between you and Dofin Tech Private Limited only, and not with Apple Inc. ("Apple"). Apple is not responsible for the app or its content.

  • Scope of Licence: the licence granted to you in Section 8 is a non-transferable licence to use the app on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
  • Maintenance and Support: Dofin Tech Private Limited is solely responsible for providing any maintenance and support for the app, as specified in these Terms or as required by applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services for the app.
  • Warranty: Dofin Tech Private Limited is solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of Dofin Tech Private Limited.
  • Product Claims: Dofin Tech Private Limited, and not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and use of it, including product liability claims, any claim that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation, including in connection with the app's use of frameworks that process health or fitness data, which this app does not use.
  • Intellectual Property Claims: in the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, Dofin Tech Private Limited, and not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of that claim.
  • Legal Compliance: you represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a terrorist-supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Third-Party Terms of Agreement: you must comply with any applicable third-party terms of agreement when using the app, including your wireless data service agreement.
  • Third-Party Beneficiary: you acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms as they relate to your licence to use the app, and that upon your acceptance of these Terms, Apple will have the right — and will be deemed to have accepted the right — to enforce these Terms against you as a third-party beneficiary.
  • Developer Contact: for any questions, complaints, or claims relating to the app, contact Dofin Tech Private Limited using the details at the end of this document.
  • If you downloaded the app from Google Play, your use is additionally subject to the Google Play Terms of Service, and you acknowledge that Google is not a party to these Terms and is not responsible for the app or its content. Google Play handles app distribution, updates, and refunds for store purchases under its own policies.

11. Privacy Policy and Data Protection

Your use of Labor App is governed in part by our Privacy Policy, which is incorporated into these Terms by reference. It describes the data we collect, including identity verification data, location, photographs, and diagnostic data, the third-party providers involved, how long we keep information, and how you can access, correct, port, or delete your data. By using the Services, you also agree to the data handling practices described there.

12. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis, to the fullest extent permitted by applicable law. Labor App disclaims all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes any warranty or right that cannot be excluded under the law that applies to you.

  • We do not guarantee uninterrupted platform uptime, error-free performance, or that the Services will always operate without delay or technical issues.
  • We do not guarantee that any job post, worker profile, communication, or hiring interaction will result in a successful outcome.
  • We do not warrant the accuracy, legality, quality, reliability, or completeness of user-generated content, verification outcomes, mapping data, or third-party statements made through the platform.

13. Limitation of Liability

To the maximum extent permitted by law, Labor App and Dofin Tech Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of, or inability to use, the Services.

This includes, without limitation, losses relating to missed hiring opportunities, job disputes, wage or payment disputes, workplace incidents, reputational harm, user misconduct, inaccurate information supplied by others, data loss, or business interruption. Where liability cannot be excluded by law, it will be limited to the minimum extent permitted. Nothing in this section limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under applicable law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Labor App, Dofin Tech Private Limited, and their directors, officers, employees, affiliates, and agents from and against any claims, demands, liabilities, losses, damages, and expenses arising from your use of the Services, your submitted content, your violation of these Terms, or your violation of applicable laws or third-party rights.

15. Account Deletion, Suspension, and Termination

You may stop using the Services at any time. You can delete your account and the personal data associated with it directly from inside the app — open your Account screen, choose the account deletion option, and confirm. If you no longer have the app installed, email us with the subject line "Data Deletion Request" or call the number listed below. Full details, including what is deleted and what may be retained, are in our Privacy Policy. Uninstalling the app does not by itself delete your account.

Labor App reserves the right to suspend, restrict, or permanently terminate your access at any time, with or without prior notice, if we reasonably determine that you have violated these Terms, misused the platform, submitted false identity or job information, created legal or safety risk, or acted in a manner that harms the platform or other users. Where it is lawful and practical to do so, we will tell you why and give you a way to respond.

Upon termination, your right to access and use the Services will immediately cease, although provisions that are intended to survive termination will remain effective, and we may retain certain records where law or an ongoing dispute requires it.

16. User Rights, Complaints, and Grievances

If you have questions about account actions, data handling, privacy rights, or legal concerns, you may contact us using the details listed below. Users in India have rights under applicable laws, including the Digital Personal Data Protection Act, 2023, and the Information Technology Act, 2000 together with the rules made under it.

  • For data deletion or privacy-related concerns, email us with the subject "Data Deletion Request" or "Data Rights Request".
  • To report a fake profile, an abusive user, an unsafe or unlawful job post, or content that infringes your rights, contact us with the relevant details so we can investigate.
  • We acknowledge grievances promptly and will review legitimate complaints and requests within a reasonable time, and no later than the period required by applicable law, subject to verification of the requester's identity.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Gurgaon, Haryana, India, unless applicable law requires otherwise. If you are a consumer resident elsewhere, nothing in this section deprives you of the protection of the mandatory consumer laws of your country of residence.

18. Modifications to These Terms

Labor App reserves the right to update or modify these Terms at any time. When we make material changes, we will update the effective date above and may notify users through the platform or other reasonable channels. Continued use of the Services after any changes take effect constitutes acceptance of the revised Terms. If you do not accept a change, you may stop using the Services and delete your account.
